Terms of Service

Last updated October 4, 2026

The short version

1. The agreement

These Terms are an agreement between you and AI Answers LLC ("Navita", "we", "us") for the Navita iPhone app, the web app at app.navita.health and the site at navita.health. By creating an account or using Navita you agree to them, to our Privacy Policy and to our Consumer Health Data Privacy Policy. If you do not agree, do not use Navita.

How you accept. You accept these Terms by ticking the agreement box on the screen shown when you first sign in (and again after we materially update them), and by using Navita. We keep a record of your acceptance: the date, the version of each document, the type of device and your IP address.

2. Navita is not medical care

Navita provides information and organization tools only. It is not medical advice, and it does not diagnose, treat, cure or prevent any disease or condition. No clinician reviews your information or Navita's output, Navita is not a telemedicine service, and using Navita does not create a doctor-patient or any other healthcare relationship.

3. Who can use Navita

You must be at least 18 and located in the United States. By signing up you confirm that you meet these requirements and that the information you give us is accurate. You are responsible for your sign-in and for activity on your account; tell us promptly at contact@ai-answers.app if you think someone else has accessed it.

4. Your content, and AI processing

You own the health information, text and photos you put into Navita ("Your Content"). You give us a limited, worldwide license to host, store, process, reproduce and transmit Your Content, including to our service providers such as our AI provider, solely to operate, secure and improve Navita for you and to comply with law, as described in the Privacy Policy. This license ends when you delete Your Content or your account, subject to the limited backup period described there.

You understand that using Navita means sending Your Content to a third-party AI provider for processing. Only share photos and information you have the right to share, and do not use Navita to store information about other people without their permission.

If you send us feedback or suggestions, we may use them without obligation to you.

5. Acceptable use

You agree not to: use Navita unlawfully or to harm, harass or defraud anyone; access it by means other than the apps and websites we provide, or scrape or probe it; interfere with, overload or circumvent its security or limits; attempt to extract the instructions or models behind it, or use its output to build a competing model; use it to provide medical services to others or to hold yourself out as a clinician; or upload content that is unlawful or that you have no right to share.

6. Beta features and changes

Navita is an evolving product. Features may be labeled or operate as beta, and we may add, change or remove features, including to improve safety, with notice where practical. We do not promise uninterrupted or error-free service. Navita relies on third-party services (such as our AI and cloud providers) and may be unavailable when they are.

7. Third-party services

Sign-in with Apple or Google, the App Store, our payment processor and our AI and cloud providers are provided by others under their own terms. We are not responsible for them, and we are not responsible for how you use them.

8. Plans, billing and renewal

Navita offers a free Trial (3 episodes in total, with no card required and no automatic charge) and paid subscriptions: Lite (5 new episodes per calendar month) and Plus (no monthly episode limit, subject to section 9), each billed monthly or annually. Prices are shown in the app before you buy and are in US dollars, plus applicable tax. The health journal is included in every plan. We may change plans, prices and what each includes; we will give you at least 30 days' notice before a price change affects your subscription, and you may cancel before it takes effect.

Automatic renewal

Paid subscriptions renew automatically at the end of each billing period, for the same length of time, at the then-current price, until you cancel. You authorize us (and Apple or our payment processor) to charge your payment method for each renewal. Renewal is charged up to 24 hours before the period ends.

Subscribing on iPhone

Payment is charged to your Apple ID at confirmation of purchase and is governed by Apple's terms. To cancel, open Settings on your iPhone, tap your name, then Subscriptions, choose Navita, and cancel at least 24 hours before the renewal date. Deleting the app or your Navita account does not cancel your subscription. Refunds for App Store purchases are handled by Apple.

Subscribing on the web

Payment is taken by our web payment processor using the method you provide. You can cancel at any time under Settings, then Billing, in the web app; cancellation takes effect at the end of the current period and you keep access until then. Except where the law requires otherwise, we do not refund payments for a period already begun.

Episode limits

Your plan limits how many new episodes you can start. If you reach the limit you can still use your journal and your existing episodes. Canceling or downgrading does not delete your information.

9. Usage limits

To protect the service we apply reasonable limits on rate, size and volume of use, including a maximum amount of activity within a single episode. "No monthly episode limit" and similar terms describe your plan's episode count and are subject to these limits. We may suspend activity that appears abusive or automated.

10. Ending your account

You can end your account at any time; see section 9 of the Privacy Policy for how to request deletion. We may suspend or end your access if you breach these Terms, if needed to protect Navita, other people or the service, or if required by law. If we end a paid web account without cause, we will refund the unused part of any prepaid period. Sections that by their nature should survive (including 2, 4, 11 to 16 and 18) do.

11. Disclaimers

To the fullest extent the law allows, Navita and everything it produces are provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including warranties of accuracy, completeness, reliability, fitness for a particular purpose, merchantability, non-infringement, and that the service will be uninterrupted, secure or error-free. We do not warrant that any output is correct or suitable for you, or that any outcome will result from using Navita.

12. Limitation of liability

To the fullest extent the law allows, Navita, AI Answers LLC and its members, managers, employees, contractors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or opportunity, or for any loss or harm arising from your reliance on Navita's output instead of professional medical advice. Our total liability for all claims relating to Navita is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim and (b) US $100.

Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, willful misconduct or gross negligence.

13. Indemnity

To the extent permitted by law, you will defend and indemnify AI Answers LLC and its members, managers, employees and contractors against claims, losses and costs (including reasonable attorneys' fees) arising from your breach of these Terms, your unlawful use of Navita, or Your Content infringing or violating another person's rights.

14. Notices and electronic communication

You agree we may give you notices electronically, by email to your account address or within the app, and that these satisfy any legal requirement for written notice. Notices to us go to contact@ai-answers.app and AI Answers LLC, 2108 N St, Ste N, Sacramento, CA 95816, USA.

15. Governing law

These Terms and any dispute relating to Navita are governed by the laws of the State of California and, where applicable, United States federal law, without regard to conflict-of-laws rules.

16. Resolving disputes: arbitration and class waiver

Please read this section carefully. It affects your legal rights, including your right to go to court and to bring or join a class action. You may opt out within 30 days as described below.

  1. Talk to us first. Before filing a claim, send a written description of the dispute and what you want to contact@ai-answers.app. We will try to resolve it informally, and neither of us may file for at least 60 days after that notice.
  2. Binding individual arbitration. Except as stated below, you and we agree that any dispute or claim arising out of or relating to these Terms, the privacy policies or Navita (including its formation, scope and enforceability) will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in effect when the claim is filed, available at adr.org. The Federal Arbitration Act governs this section. Hearings may be by phone or video, or in the county where you live. We will pay the filing, administrative and arbitrator fees to the extent those exceed what you would pay to file in court. An arbitrator can award the same individual relief a court could.
  3. No class actions. You and we may bring claims against each other only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine claims or preside over any form of class or representative proceeding. A court, not the arbitrator, decides whether this waiver is enforceable. If it is found unenforceable as to a claim, that claim (and only that claim) must be brought in court and any remaining claims proceed in arbitration.
  4. Coordinated filings. If 25 or more similar claims are filed by or with the help of the same lawyers or group, the parties will follow a staged process: arbitrations are decided in batches of up to 10 at a time, with the others paused and any limitation periods tolled until their turn.
  5. What is not covered. Either of us may bring an individual claim in small-claims court if it qualifies. Either of us may seek an injunction in court to stop infringement or misuse of intellectual property or unauthorized access to Navita. A claim for public injunctive relief that the law does not allow to be arbitrated may be brought in court, and will be paused until any arbitrable claims are decided.
  6. Opt out. You may opt out of this section by emailing contact@ai-answers.app within 30 days after you first accept these Terms, with your name, your account email and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
  7. Court for everything else. Any dispute that is not subject to arbitration will be brought only in the state or federal courts located in Sacramento County, California, and you and we consent to their jurisdiction.
  8. Changes. If we change this section, the change applies only to claims arising after you receive notice, and you may reject it by emailing us within 30 days of the notice.
  9. Severability. If any part of this section other than the class waiver is found unenforceable, the rest remains in effect.

17. Apple App Store users

If you downloaded Navita from the Apple App Store: (a) these Terms are between you and AI Answers LLC only, not Apple; (b) Apple has no obligation to provide maintenance or support for Navita; (c) if Navita fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price, and to the maximum extent the law allows Apple has no other warranty obligation; (d) Apple is not responsible for addressing claims relating to Navita or your use of it, including product liability, legal or regulatory compliance, or consumer protection claims, or for intellectual property claims; (e) you represent that you are not in a country subject to a US embargo or on a US list of prohibited parties; (f) you must comply with applicable third-party terms; and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. General

These Terms, with the policies they reference, are the entire agreement between us about Navita and replace earlier versions. If a provision is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours in a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. No third party has rights under these Terms except as stated in section 17.

California users. Under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs (dca.ca.gov) about a complaint.

19. Changes to these Terms

We may update these Terms. If a change is material, we will give you notice in the app or by email before it takes effect, and we may ask you to accept the new Terms to continue. If you keep using Navita after the change takes effect, you accept it. If you do not agree, you can stop using Navita and delete your account.
